Controversial police Superintendent Hansel Marantan, the ground commander in the deadly shooting incident in Quezon province last Jan. 6, faces obstruction of justice charges if he still refuses to cooperate in an investigation.
 
Justice Secretary Leila de Lima stressed this in a radio interview Friday morning as she said Marantan has no reason not to submit himself to an investigation.
 
"Kung ayaw niyang mag-cooperate, pwede (siyang) kasuhan ng obstruction of justice," she said in an interview on dzBB radio.
 
She said Marantan now has no more justification not to submit himself to the National Bureau of Investigation, which she said is the "proper investigating body."
 
President Benigno Aquino III had tasked the NBI as the sole body to investigate the incident.
 
Thirteen men were gunned down in the incident at Atimonan town in Quezon province last Jan. 6.
 
While police initially said the incident was a shootout with members of a gun-for-hire gang, investigators have found indications it was not.
 
On Thursday, de Lima said their findings so far show the Jan. 6 incident was not a shootout.
 
De Lima indicated Marantan should submit his firearm for examination by investigators.
 
If he still refuses, she said that would indicate "the only intention is ayaw niya malaman ang katotohanan."
 
NBI to visit Marantan
 
A separate report by dzBB's Carlo Mateo said an NBI team was to visit Marantan at the hospital where he was confined.
 
Marantan had suffered gunshot wounds during the Jan. 6 incident.
 
The report quoted NBI death investigation unit head Danielito Lalusis as saying a slug recovered from Marantan's body had been turned over to them. —KG, GMA News
