Workers in private schools who reported for work last Monday may be entitled to a higher pay for the day, the Department of Labor and Employment said.
But DOLE Secretary Rosalinda Baldoz reiterated that Feb. 25 (Monday) was an ordinary workday for other private establishments as the day is a special holiday only for schools.
"(F)or the private school, employees, whether academic or administrative personnel, shall be paid in accordance with the rules for pay on special (non-working days)," the DOLE said.
Baldoz cited President Benigno Aquino III's Proclamation No. 459, which declared Feb. 25 a special holiday for schools.
On the other hand, she said "no premium is required to be paid for work" in other private establishments on last Monday.
Pay rules
Baldoz said employees in private schools, including academic and administrative personnel, may be paid in accordance with the rules for pay on special (non-working) days.
The rules:
- For an employee who did not work on Monday, the “no work, no pay” principle shall apply, unless there is a favorable company policy or collective bargaining agreement (CBA) granting payment on a special day.
- If the employee worked, he/she shall be entitled to an additional 30 percent of his/her daily rate on the first eight hours of work.
- If the employee worked more than eight hours (overtime), he/she shall be paid an additional 30 percent of his/her hourly rate on the said day.
- If the employee worked during a special day that also falls on his/her rest day, he/she shall be paid an additional 50 percent of his/her daily rate on the first eight hours of work.
- If the employee worked more than eight hours during a special day that also falls on his or her rest day, he/she shall be entitled to an additional 30 percent of his/her hourly rate on said day.
